Selling Order: We will sell each parcel by the acre with the winning bidder having the choice of whichever parcel(s) they desire. Once each parcel has a winning bidder, we will then offer the property in the following combinations:

Mineral Rights: Oil and gas rights are held by production and retained by a previous seller.

Property sells subject to the following restrictions:

  1. No commercial poultry, swine facilities or dog kennels shall be erected in the subdivision.
  2. No property shall exceed a consistent noise level above 80 decibels.
  3. All Dwellings must provide a minimum of 1500 Sq. Ft. of habitable living space.
  4. Building set backs shall be a minimum of 20 feet from front and 10 feet from side of any lots.
  5. No mobile or manufactured homes shall be permitted. Industrialized (modular) dwellings units built to conform to the Ohio Basic Building Code and so affixed with a seal of state inspection shall be permitted subject to their placement on a frost free foundation and connection to appropriate utilities.
  6. There shall be no outside storage of junk, scrap materials or inoperable vehicles of any kind.
  7. These restrictive covenants shall run with the land. They may be changed by agreement of all the members of the Wooded Peaks Subdivision.

Terms: The successful purchaser(s) will be required a non-refundable down payment of 10% at the auction with the balance due at closing after completion of final survey.  A 10% buyer’s premium will be added to the final bid to determine the final purchase price.  Any county required septic design and plot plans will be at the buyer’s expense.
